-July 14, 2008
Eli Lilly and Co. is reportedly facing another protracted legal battle over whether they improperly marketed their once top-selling medication, Zyprexa.
The current issue regarding the medication, which is prescribed to treat schizophrenia and bipolar disorder, is a debate over whether the drug has been improperly marketed.
Many are also questioning whether patients have been overcharged for the prescription and Lilly may now be forced to pay billions to insurers.
Case Questions Lily as a Drug Manufacturer
Jack Weinstein, the U.S. District Judge recently issued a draft in the case against Eli Lilly and Co., and questions whether Lilly encouraged questionable uses for the Zyprexa.
As one of the largest private employers in Indianapolis, Lilly has reportedly already paid $1 billion to settle personal injury claims against patients who suffered from unknown side effects caused by the medication.
According to the plaintiff’s, Lilly’s actions have resulted in them being overcharged by Zyprexa by as much as $7.7 billion.
Medication Wrongly Marketed
“There is sufficient evidence that off-label use of Zyprexa was excessive and may have been encouraged by Lilly,” commented the judge.
For several years the company has denied all allegations made against them and downplayed the side effects found in the medication.
